The hidden AI in your store
If your Shopify store uses any of these popular apps, you're using AI — and likely subject to disclosure rules in Colorado, Illinois, and California:
- Klaviyo with predictive analytics or AI segments
- Yotpo for AI-generated review summaries
- Rebuy / Nosto recommendation engines
- Drift / Tidio / Intercom chat widgets (almost all use AI now)
- Klevu / Algolia NeuralSearch AI-powered search
- HubSpot conversational AI
Why this matters now
Colorado SB 24-205 enforcement starts June 30, 2026 with $20K/violation fines. The Colorado AG will look for the easy wins first — Shopify stores with chat widgets and no disclosures are sitting ducks.
Three steps to compliance
- Step 1: Inventory. Check your Shopify Apps and Theme code for any of the tools above. Or run an automated scan.
- Step 2: Disclose. Add a banner or footer note: "This site uses AI tools (chat, recommendations, search) which may make automated decisions. See our privacy policy for opt-out options."
- Step 3: Document. In your privacy policy, list each AI tool, what data it processes, and how customers can opt out.

What about the chat widget specifically?
If your chat widget uses AI (which Drift, Tidio, Intercom, and most others do as of 2025), you should add an in-widget disclosure: "You're chatting with an AI. Type 'human' to be connected to a person."
